Notice to all TLS license and permit holders

PLEASE BE ADVISED that Port Metro Vancouver and the Ministry of Transportation and Infrastructure will implement enhancements to the container truck licensing dispute resolution program beginning February 1. These changes will enhance the effectiveness of the dispute resolution program. Key enhancements to the program include: 

Audits

  • Greater emphasis will be placed on companies that do not satisfactorily pass a first audit.

  • Repeat audits will be routinely conducted on all companies found in non-compliance with the licence agreement. 

  • Repeat audits will cover time subsequent to the first audit period, and may also cover periods prior to the months covered by the first audit. 

  • Audit costs will be assigned to companies found to have underpaid their drivers. The proceeds will be used to support additional enforcement of the program. 

  • Interest will now be charged on all monies owing to drivers.

Sanctions and Penalties

  • The educational phase of the program will end.

  • Port Metro Vancouver will begin to apply greater sanctions and a range of penalties under the licence agreement including suspensions and termination of licences.

  • A company's lack of cooperation with respect to providing records or to making payments will result in greater sanctions.

  • In considering any recommendation from the Chair Arbitrator, Port Metro Vancouver will also consider the entire record of the company concerning all of its obligations under the licence agreement, not only the remuneration provisions. 

  • Port Metro Vancouver may elect to impose sanctions greater than those recommended by the Chair Arbitrator. 

Port Metro Vancouver will continue to issue licenses to qualified companies. Concerns regarding the moratorium on owner operators and the number of new licenses issued to companies hiring employee drivers may be brought to the attention of Mr. Graham Kee, Vice President, Port Metro Vancouver.

 

The Port will cancel Licenses and Permits for those found disrupting traffic on or to Port Metro Vancouver property.
